These Terms & Conditions (“Terms”) govern your use of revupnow.com (the “Site”) and any consultation, proposal, or service engagement with RevUp Now (“RevUp Now,” “we,” “us,” or “our”), an AI operations partner headquartered in Albuquerque, New Mexico. By using the Site or engaging our services, you agree to these Terms. If you don’t agree, please don’t use the Site or engage our services.
RevUp Now builds, implements, and maintains custom AI automation for service businesses — identifying the highest-cost manual task in a client’s operation and running it as an ongoing service, wired into the client’s existing software. Nothing on the Site is a guarantee of specific results; actual outcomes depend on your business, your data, and the systems we integrate with.
You agree to use the Site only for lawful purposes. You won’t attempt to interfere with the Site’s normal operation, scrape or copy its content for commercial redistribution, misrepresent your identity when submitting a form, or use the Site to transmit anything harmful, infringing, or unlawful. We may suspend or restrict access to the Site for anyone who violates these Terms.
Submitting a form or booking a call through the Site is a request for a conversation — it does not create a binding service agreement. A service engagement begins only once we’ve scoped the work and both parties have agreed on the specific task, deliverables, timeline, and fees, typically documented in a separate proposal or service agreement. Where these Terms and a signed proposal or service agreement conflict on engagement-specific matters, the signed agreement controls.
Our standard model is a flat fee for the initial build, followed by a flat monthly retainer to run, maintain, and improve the automation, as described on the relevant service page and confirmed in your proposal. Fees, payment schedules, and any refund terms are set out in your specific proposal or service agreement. Engagements are month-to-month after the build unless your agreement states otherwise — either party may cancel the ongoing retainer per the notice terms in that agreement.
Our Site and materials. The content, design, graphics, and materials on the Site are owned by RevUp Now or our licensors and are protected by intellectual-property law. You may not reproduce, distribute, or create derivative works from Site content without our permission.
Custom automations we build for you. Ownership of the specific automation, workflow, or integration we build for a client is defined in that client’s service agreement. Unless that agreement says otherwise, RevUp Now retains ownership of its underlying tools, templates, frameworks, and proprietary methods used to build and run client automations, while the client owns their own business data processed through them.
Our work typically integrates with software you already use — such as ServiceTitan, QuickBooks, Housecall Pro, Jobber, Clio, or similar platforms named on our service pages. We are not responsible for outages, changes, or limitations in third-party software that affect the automations we’ve built, though we’ll work with you to adapt where reasonably possible.
In the course of scoping and delivering work, we may receive confidential business information from you (pricing, customer data, internal processes). We will use that information only to deliver the services you’ve engaged us for and will not disclose it to third parties except as needed to perform the work (e.g., to a named subcontractor or integration partner) or as required by law.
The Site and its content are provided “as is” without warranties of any kind, express or implied. We don’t warrant that the Site will be uninterrupted, error-free, or secure. Statements about outcomes on our service pages (e.g., typical build timelines) are general expectations, not guarantees, since results depend on factors specific to your business and the systems we integrate with.
To the fullest extent permitted by law, RevUp Now will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from your use of the Site or our services — even if we’ve been advised of the possibility of such damages. Our total liability for any claim arising from a service engagement is limited to the amount you paid us for that engagement in the twelve months before the claim arose, unless your signed service agreement states a different limit.
You agree to indemnify and hold RevUp Now harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.
We may suspend or terminate your access to the Site at any time for conduct that violates these Terms. Termination of an active service engagement is governed by the notice and termination terms in your specific service agreement.
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-laws principles. Any dispute arising from these Terms or our services will be subject to the exclusive jurisdiction of the state or federal courts located in New Mexico, and you consent to that jurisdiction and venue.
We may update these Terms from time to time. Changes take effect once posted on this page with a revised effective date. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms. Terms for an active, signed service agreement are governed by that agreement unless both parties agree to an amendment.
